What are cadastre services?

Cadastre and land registry services form a system for keeping track of properties and their owners. In our country, this record is managed by the National Agency for Cadastre and Real Estate Publicity. The cadastre and land registration work is carried out by natural or legal persons authorised by ANCPI and is endorsed by the county cadastre and land registration offices. When do we need cadastre services?

Usually when we sell or when we want to build, but there can be other situations as well. Even if you have ownership documents for your property, the transfer of ownership is conditional on the property being registered in the Cadastre and Land Registry system. Also, in the case of obtaining the construction or demolition permit, it is mandatory that the building be registered in the land register.

What are the stages for creating the cadastre?

First of all, you should know that you cannot register in the cadastre and land registry system properties for which there are no title deeds, so the most important condition is the existence of title deeds.

The next step is to carry out field measurements. A team consisting of an expert and an assistant will travel to your property to take measurements. These measurements are made using special instruments, with which coordinates are determined in Stereo 70 national reference system. Depending on the type of work, the position of fences and buildings is measured in the field, so that the areas of the buildings can be determined and that the measurement of the position of the fences is done to determine the boundary of the building.

Based on the measurements made in the field, together with the documents proving the property right, we prepare the cadastral documentation to be submitted for approval to Cadastre Office. This is the last step in obtaining the land register for your property.

How long does it take to complete the cadastre?

The time required to carry out the measurements and draw up the cadastral documentation is 3 working days from the date on which the owner provides us with all the required documents, plus the deadline for the approval of the documentation at OCPI.

Depending on the history and current situation of your property you may need the following services:

I.Drawing the property boundary or registration of the property

Whether you want to buy land and want to find out exactly where it is, have inherited land and don't know its location, or want to build a fence and don't want to cross the property line, land registration is what you need. With this operation we trace and mark in the field all the points on the contour of the land, the only condition is that the land has a cadastre. All we need from you is the cadastral number or land register number of the property. We obtain the coordinates of the land from the ANCPI databases to which we have access, as authorised individuals, and once we have traced the land we issue you with a Tracing Report, a document which certifies that the property boundary has been traced by an authorised person.

II. First entry in the land register.
 

This is required if your property has not been previously registered in the land register. Since a new land register is being created, the following documents will be needed when drawing up the file:

  • Title deed - certified copy;
  • Tax certificate - original;
  • CI copy of all owners;

Depending on the legal situation of each property, other documents may be required in addition to those listed above.

III. Updating technical information:

Applies to properties previously entered in the land register where the situation on the ground no longer corresponds to the situation at the time of entry in the land register. Depending on the type of changes to the property, the following information may be updated:

  1. Surface modification - is among the most common update situations. For buildings in the countryside, the area can be increased by up to 15% of the area entered in the land register, while for those in the countryside the limit is a maximum of 5%. There is no set limit for downgrading. The area must be changed with the owner's authenticated consent, expressed in a notarial declaration.
  2. New construction registration - Once a new building is completed, the ownership of the building must be registered in the land register. Registration is based on the following documents:
  • Building permit together with the plans of the project on which it was based - certified copy;
  • Acceptance report at the end of the works - certified copy;
  • Certificate of attestation of construction - certified copy;
  • Tax certificate - Original;
  • Marriage certificate, if the building owner is married - certified copy;
  • Copy CI owner;
  • Copy of the location and demarcation plan of the land.

3. Extension of existing building - In this situation, the same rules apply to land registry registration as to the registration of a new construction, the only difference being the OCPI fee, which is fixed in this situation.

4. Removal of a building from the land register - A building can only be removed from the land register on the basis of the following documents:

  • Demolition permit - certified copy;
  • Minutes of acceptance at the end of demolition - certified copy;
  •  

In certain exceptional circumstances, buildings can also be written off on the basis of certificates issued by local authorities.

5. Update postal address in land register- applies when the actual address of the property has been changed from that entered in the land register. The update is made on the basis of the street classification certificate or certificate issued by the town hall of the administrative unit to which the property belongs.

6. Updating the property boundary -is mainly used for buildings registered in the land register before the implementation of the compulsory expression of coordinates in the national coordinate system Stereographic 1970. That is to say, before 2006 until the coordinates of buildings were determined in local coordinate systems in certain areas.

IV. Corrigendum - Correction of material error

It is used to correct certain errors that may occur during the process of drawing up and approving the cadastral documentation or when there is an inconsistency between the property deeds and the information in the land register. The correction is made on the basis of the document that certifies that the information in the land register is wrong. This operation can also be used to reposition the property in order to eliminate virtual overlaps, provided that the surface area of the property does not change, in which case the surface area modification operation is used.

V. Land clearance / Divestment

This operation subdivides an existing plot of land into two or more lots. In order to subdivide land, it must be entered in the land register. The land is divided up in the following stages:

  1. Carrying out field measurements and processing them. Depending on the situation, an updating operation may be necessary beforehand;
  2. Preparation of the dismantling proposal, with the shape, dimensions and areas of the lots to be dismantled, based on the specifications received from the beneficiary;
  3. Obtain the town planning certificate for dismantling from the town planning department of the town hall to which the property belongs;
  4. Preparation of the cadastral documentation for dismemberment and its submission to the Cadastre Office for approval;
  5. With the documents issued by the land registry office, the beneficiary contacts a notary's office to draw up the deed of demolition and register it in the land register. Following this operation, each property will have its own land register;

 

In the case of annexations, the same procedure applies, but after processing the measurements, a single plot of land will result from several annexed plots.
